High Court
Some of us found ourselves in the High Court last week.
The Merton Green Action Group were named defendants by Barratt Homes who are seeking a declaration that building should be allowed to continue under a previous legislation..Town and Country Planning Act 1990 sec.241.
We have always been led to believe by Defra and other sources that Village Green status overides this legislation as brought in by the Commons Act 2006[and 2007 in Wales]
It has never been decided in a Court of Law so it will be a landmark case whatever the decision.
The judge heard both sides of the argument and has decided to deliver a written judgement on the matter within the next few weeks.
